1.Acceptance of Terms
These Terms of Service (“Terms”) form a legal agreement between you and Genera AI (“we”, “us”, or “our”) governing your access to and use of the Genera AI mobile application and website located at https://genera-ai.evtsoy.com(collectively, the “Service”).
By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.
2.Description of Service
Genera AI is an iOS application that allows users to generate images and videos using third-party artificial intelligence models (including but not limited to FLUX, GPT-Image-1, Imagen 4, Seedream, PixVerse, and Seedance). The AI models themselves are operated by third-party providers; Genera AI serves as a convenient interface to access them.
The Service is provided on an “as is” basis. AI models are probabilistic and outputs may vary. We do not guarantee that any specific prompt will produce a specific result.
3.Eligibility
You must be at least 13 years of age (or the minimum age required by applicable law in your jurisdiction) to use the Service. By using the Service you represent and warrant that you meet this requirement.
If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4.User Accounts
Access to the Service requires authentication via Sign in with Apple. You are responsible for maintaining the confidentiality of your Apple ID and for all activities that occur under your account.
You agree to notify us immediately if you suspect any unauthorised use of your account. We will not be liable for any loss resulting from unauthorised use of your account.
5.Credits & Payments
Credits
Genera AI operates on a credit-based system. Credits are consumed each time you submit a generation request. The number of credits required varies by model and configuration and is displayed before you submit a request.
Purchasing credits
Credits are purchased as in-app purchases through the Apple App Store. All transactions are subject to Apple's payment terms. Prices are displayed in your local currency and may vary by region.
Refunds
- Credits are non-refundableexcept where required by applicable law or Apple's refund policy.
- If a generation fails due to a technical error on our side, the credits charged for that generation are automatically refunded to your balance.
- For disputes about App Store purchases, please contact Apple Support directly.
Expiry
Purchased credits do not expire while your account remains active. We reserve the right to implement expiry policies in the future with reasonable prior notice.
Free credits
New accounts receive a one-time welcome grant of free credits. Free credits have no cash value and cannot be transferred or redeemed.
6.Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal in your jurisdiction
- Generate content depicting or sexualising minors (CSAM) — this is strictly prohibited and will result in immediate account termination and reporting to relevant authorities
- Generate content intended to harass, threaten, or defame any individual
- Generate non-consensual intimate imagery or deepfakes of real people
- Infringe the intellectual property rights of any third party
- Attempt to circumvent safety filters built into the AI models
- Automate requests or scrape the Service without our written consent
- Resell or redistribute access to the Service
We reserve the right to suspend or terminate accounts that violate these rules without prior notice and without refunding remaining credits.
7.Your Content
You retain ownership of the prompts you write. You also retain any rights you may have in the images or videos generated at your direction, subject to the terms of the underlying AI model providers and applicable law.
By using the Service you grant us a limited, non-exclusive licence to store, process, and display your content solely to operate and provide the Service to you.
You are responsible for ensuring your use of generated content complies with applicable laws, platform policies, and third-party rights. We make no warranty regarding the commercial usability of any AI-generated output.
8.Intellectual Property
The Genera AI name, logo, app design, and source code are owned by us and protected by intellectual property law. Nothing in these Terms grants you any right to use our trademarks, trade dress, or branding.
The AI models accessible through the Service are the intellectual property of their respective providers (Black Forest Labs, OpenAI, Google DeepMind, Hedra, ByteDance, etc.) and are subject to their respective licences.
9.Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected. AI-generated outputs are probabilistic and may be inaccurate, offensive, or otherwise unsuitable for your needs.
10.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GENERA AI, ITS OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
11.Termination
You may stop using the Service at any time. To request deletion of your account and data, contact us at support@evtsoy.com.
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases and any unused credits are forfeited, except where required by law.
12.Changes to Terms
We may revise these Terms from time to time. We will update the effective date at the top of this page when we do. Material changes will be communicated via an in-app notice or email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13.Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation; if unresolved, through binding arbitration or the courts of competent jurisdiction.
